24 year-old Tommy Braden who was wrongfully arrested last April 6 and left to rot in detention till July 3rd in Sapulpa, 15 miles
southwest of Tulsa, after a DNA test conducted later proved his innocence. He had reported the attack on the four-year-old
girl.
His lawyer, Don Smolen has sent notice to the Creek County Sheriff's
Office alleging wrongful arrest and detention, as a result of police
negligence. In Smolen's words while speaking to Tulsa World Newspaper, he said:
"From day one he's begging them to do a DNA test... They said they weren't going to do that because it was a waste of
taxpayers' dollars.Three months later - after his life's gone to hell -
the results he's been asking them to do comes up that he's not the guy."
Smolen also added that investigators originally refused to believe his client's
story. A lie detector test also found him to be deceptive and the victim identified Mr Braden as the attacker.
The DNA test was a match for Patrick Edward Misner, a convicted felon who lived in the same mobile home park as the victim.
The sheriff's office declined to comment on the legal action. It has
three months to respond or possibly face a civil rights lawsuit.
